QA Board Terms of Service

1. General provisions

1. These Terms of Service set out the rules for using the online platform operating under the name QA Board, available at https://qaboard.pl/ and at other addresses, domains or subdomains indicated by the Service Provider.

2. The owner and operator of the QA Board platform is Quality Island Sp. z o.o., with its registered office at ul. Grzybowska 87, 00-844 Warsaw, Poland, Tax ID (NIP): 5273002880, entered in the register of entrepreneurs of the National Court Register (KRS) under number 0000972652, REGON: 522066058, contact email address: kontakt@qualityisland.pl or another address indicated on the platform.

3. QA Board is a platform that makes it possible to present the profiles of specialists in QA, software testing, test automation, cybersecurity, digital accessibility, DevOps, quality analysis, quality management and related areas of IT, and that allows business clients to register their interest in cooperation, recruitment, the outsourcing of a specialist or a team, or a service delivered by Quality Island.

4. The platform is informational, presentational, contact-oriented and recruitment and sales oriented in nature. Unless expressly stated otherwise, the mere use of the platform, browsing profiles, saving filters, submitting a form, or clicking a button such as "Start recruiting", "View profile", "Hire an expert" or any similar button does not automatically conclude an agreement for recruitment, outsourcing, consulting or training services, or any other agreement for consideration.

5. Entering into an agreement with Quality Island requires, in each case, a separate confirmation of the terms of cooperation by Quality Island, in particular in documentary, email or electronic form, by signing an agreement or by accepting an offer, an order, a statement of work, a service order, an order form or another commercial document.

6. These Terms of Service have been prepared in order to ensure safe and lawful use of the platform and to protect the interests of Quality Island, clients, candidates, specialists and other users of the platform.

2. Definitions

For the purposes of these Terms of Service, the terms below have the following meanings:

1. Platform or QA Board - the website operated by Quality Island that makes it possible to present the profiles of QA & Testing specialists and to make contact regarding cooperation.

2. Service Provider or Quality Island - Quality Island Sp. z o.o., with its registered office in Warsaw.

3. User - any natural person, legal person or organisational unit using the platform, including a person browsing the platform, a client, a client's representative, a specialist, a candidate, a business partner or any other person visiting the platform.

4. Client - an entrepreneur, legal person, organisational unit, institution or other entity interested in cooperating with Quality Island, in particular in employing, outsourcing, hiring, recruiting, consulting or contracting a QA specialist or team.

5. Specialist - a person whose profile, competences, experience, availability, expected remuneration, working mode, certificates, technologies or other information may be presented on the platform.

6. Specialist profile - a set of information about a specialist, in particular their role, level of experience, specialisation, technologies, tools, languages, certificates, preferred working mode, availability, type of contract, expected remuneration or rate, domain areas and other information relevant to possible cooperation.

7. Services - the services provided by Quality Island through or in connection with the platform, in particular making the platform available, presenting profiles, handling enquiries, contact with clients, verifying interest in cooperation, recruitment support, outsourcing of specialists, outsourcing of teams, QA consulting, testing services, training services, advisory services and other services indicated by Quality Island.

8. Content - any data, information, text, markings, graphics, profiles, descriptions, logos, photographs, contact details, files, comments, forms, replies, messages or other materials posted, sent, processed or made available in connection with the platform.

9. Account - individual access to the functions of the platform, if such functionality is made available by Quality Island.

10. Terms of Service - this document.

3. Nature of the platform and scope of services

1. QA Board serves in particular to:

present verified or preliminarily verified profiles of QA & Testing specialists,

allow clients to filter profiles by role, level of experience, technologies, working mode, type of contract, availability, language, domain, certificates and other criteria,

allow clients to register their interest in working with a specialist or a team,

support the process of matching specialists to clients' projects,

present Quality Island's offer in the area of recruitment, outsourcing, software testing, consulting, training and QA services,

carry out Quality Island's information, marketing, sales and business activities.

2. QA Board is not an employment agency or a job placement intermediary, to the extent that a given service has not been expressly classified and confirmed as a job placement or personnel consultancy service in a separate agreement.

3. QA Board is not a public database, a catalogue for free copying, a source for bulk downloading, or a tool for the automated harvesting of data about specialists.

4. Specialist profiles are indicative, informational and promotional in nature. They do not constitute an offer within the meaning of the Polish Civil Code, unless Quality Island expressly states otherwise in individual correspondence or in a separate offer.

5. The information visible on the platform, including remuneration, rates, availability, working mode, level of experience, technologies, certificates and readiness to start work, may change and requires confirmation by Quality Island in each case.

6. Quality Island may at any time change the scope of the platform's functionality, its appearance, the number of available profiles, the filtering criteria, the way specialists are labelled, marketing content, contact paths and the model of cooperation.

7. Quality Island may temporarily or permanently withdraw any profile, function, module, filter, label, section or element from the platform, without having to give a reason, subject to mandatory provisions of law.

4. Rules for using the platform

1. Users undertake to use the platform in accordance with the law, these Terms of Service, good practice, principles of community life, the rules of fair competition and the intended purpose of the platform.

2. It is prohibited in particular to:

use the platform for unlawful activities or activities that infringe the rights of Quality Island, specialists, clients or third parties,

copy, scrape, index, automatically download, aggregate, save in bulk, record or further distribute specialist profiles or data available on the platform without the prior written consent of Quality Island,

use bots, crawlers, scripts, automation, AI tools, plug-ins, data extraction tools, scraping tools or similar mechanisms to download or analyse the platform,

circumvent the platform's security measures, access limits, filtering mechanisms, authorisation mechanisms or other technical measures,

attempt to gain unauthorised access to the systems, data, accounts, profiles, administration panels or infrastructure of Quality Island,

take actions that may disrupt the operation of the platform, including DDoS attacks, penetration testing without consent, vulnerability scanning, attempts to overload the system, code injection, sending malware, exploits or other harmful content,

impersonate other people or entities,

provide false, misleading, out-of-date or other people's data,

use the platform to bypass Quality Island and contact specialists directly in order to circumvent Quality Island, where the specialist's details or the ability to contact them were obtained thanks to the platform, a presentation, a recommendation, a conversation, an offer or the activities of Quality Island,

take actions that compete with Quality Island using the data, profiles, descriptions, concepts, structure, markings, filters, databases or other elements of the platform,

infringe the trade secrets of Quality Island or of third parties,

publish or send content that is unlawful, offensive or discriminatory, or that infringes personality rights, copyright, trade mark rights, image rights, privacy or the protection of personal data.

3. Users bear full responsibility for their acts and omissions on the platform and for the content, data and information provided to Quality Island.

4. Quality Island may apply technical, organisational and legal measures to protect the platform, including request limits, IP address blocks, anti-bot mechanisms, security monitoring, event logging, user verification, access restrictions and other safeguards.

5. Breaching the rules for using the platform may result in temporary or permanent blocking of access to the platform, refusal to handle an enquiry, refusal to enter into an agreement, termination of cooperation, the pursuit of damages and notification of the competent authorities.

5. Specialist profiles, verification and no guarantee of employment

1. Quality Island exercises due care to ensure that the specialist profiles presented on the platform are reliable, up to date and useful in business terms.

2. Labels such as "verified", "reply within 48h", "precise match", "availability", "immediately available", "senior", "mid", "junior", "B2B", "employment contract", "remote", "hybrid", "on-site" or similar are informational and organisational in nature. They do not constitute a guarantee that an agreement will be concluded, that a specialist will be available, of the quality of work, of the effectiveness of recruitment, of achieving a particular result, or of the absence of project risk.

3. Quality Island may verify specialists on the basis of documents, interviews, experience, portfolios, competence tests, certificates, references, history of cooperation, the specialist's own declarations or other methods considered appropriate.

4. The scope of verification may differ depending on the specialist, the project, the type of cooperation, the information available and the client's needs.

5. Quality Island does not guarantee that every specialist:

will be available at the moment the client makes contact,

will accept the client's terms,

will pass the client's recruitment process,

can be contracted within the expected timeframe,

will meet all of the client's technical, formal, organisational or legal requirements,

will achieve a particular result in the client's project.

6. The decision to invite a specialist to an interview, to employ or contract them, to grant them access to systems, to assign permissions or tasks, or to enter into an agreement rests with the client, unless a separate agreement provides otherwise.

7. The client is obliged to assess for itself whether a specialist is suitable for its own needs, in particular as regards competences, experience, availability, security, regulatory requirements, conflicts of interest, compliance with the client's policies and the requirements of the project.

8. If the client requires additional verification of a specialist, in particular a background check, technical tests, reference checks, the signing of an NDA, completion of security procedures, the provision of certificates, confirmation of a clean criminal record or compliance checks, it should notify Quality Island before the cooperation begins.

6. Client enquiries and the process of starting cooperation

1. A client may register its interest in cooperation through a form, a button available on the platform, an email message, a telephone call, a meeting calendar, a contact form or another channel indicated by Quality Island.

2. Sending an enquiry does not oblige Quality Island to present an offer, to reserve a specialist, to start a recruitment process, to provide services or to enter into an agreement.

3. Quality Island may refuse to handle an enquiry, in particular where:

the enquiry is incomplete, unreliable or contrary to the law or to Quality Island's rules of cooperation,

the client competes with Quality Island or there is a risk of Quality Island being bypassed,

the client demands actions that are contrary to the law, to ethical standards, to security requirements or to good IT practice,

the client expects guarantees that cannot be given,

the project may infringe the rights of third parties, data protection law, trade secrets, the security of systems or the interests of Quality Island,

the client is in arrears with payments to Quality Island or to affiliated entities,

there is a reasonable suspicion of misuse of the platform.

4. Quality Island may ask the client for additional information, in particular a description of the project, technical requirements, the expected duration of the cooperation, the working model, location, budget, the expected type of contract, security requirements, legal requirements, language requirements and the details of contact persons.

5. Before cooperation begins, the parties may agree separate documents, in particular a service agreement, a framework agreement, an NDA, a DPA, an order, an SOW, recruitment terms, outsourcing terms, payment terms, an SLA, security rules or other project documents.

6. In the event of any discrepancy between these Terms of Service and an individual agreement concluded with a client, the individual agreement prevails, unless expressly stipulated otherwise.

7. Prohibition on bypassing Quality Island

1. The client undertakes not to bypass Quality Island in its relationship with specialists whom it has met, found, received, seen, identified or contacted thanks to the platform, materials, a recommendation, an offer, a presentation, a meeting, correspondence or other activities of Quality Island.

2. Without the prior written consent of Quality Island, the client may not, directly or indirectly:

employ a specialist,

enter into a B2B agreement, a contract of mandate, a contract for specific work, a consulting agreement or any other agreement with a specialist,

start cooperation through an affiliated entity, a partner, an end client, a subsidiary, a parent company, a subcontractor, an agency or any other third party,

pass a specialist's details to another entity,

use information about a specialist to avoid the remuneration or commission due to Quality Island.

3. The prohibition referred to above applies for a period of 12 months from the date on which the profile, recommendation, meeting, conversation, correspondence or other contact concerning that specialist was last provided, unless a separate agreement provides for a different period.

4. In the event of a breach of the prohibition on bypassing Quality Island, Quality Island may claim from the client a contractual penalty of PLN 25,000 net for each breach, without prejudice to its right to claim damages exceeding the amount of the contractual penalty under the general rules of civil law.

5. The provision on the contractual penalty applies only to clients who are not consumers and who are not sole traders treated as consumers, unless mandatory provisions of law permit a different solution.

8. Remuneration, rates and financial terms

1. The rates, remuneration, ranges, prices, budgets, net amounts, gross amounts, currency markings, types of contract and information about B2B, employment contracts or other models of cooperation presented on the platform are informational and indicative, unless Quality Island expressly confirms otherwise in a separate offer.

2. The final financial terms of cooperation require individual confirmation by Quality Island and may depend in particular on the scope of the project, the duration of the cooperation, the availability of the specialist, the contractual model, project risks, the client's requirements, the working mode, language, security requirements, the urgency of the project and other arrangements between the parties.

3. The prices presented on the platform do not include taxes, additional costs, administrative costs, travel costs, tool costs, licence costs, onboarding costs, or the cost of work outside standard hours, at weekends or on public holidays, unless expressly stated otherwise.

4. Quality Island reserves the right to change rates, remuneration and financial terms at any time; such a change does not affect terms already accepted by the parties in a separate agreement, unless that agreement provides otherwise.

9. Liability of Quality Island

1. Quality Island is liable for the proper provision of services solely to the extent arising from mandatory provisions of law and from separate agreements concluded with the client.

2. To the maximum extent permitted by law, Quality Island is not liable for:

business, recruitment, HR, technical or organisational decisions taken by the client on the basis of the information available on the platform,

the failure to conclude an agreement with a specialist,

the unavailability of a specialist,

changes in a specialist's financial expectations, availability or preferences,

the client's failure to achieve a particular business, project, financial, technical or organisational result,

errors, failures, delays, loss of data, indirect damage, lost profits, lost revenue, loss of reputation, loss of clients, business interruption or substitute costs, unless mandatory provisions of law provide otherwise,

the acts or omissions of specialists, clients, users, technology providers, payment operators, hosting operators, infrastructure providers, internet service providers or other third parties,

content or data provided by users, clients, specialists or third parties,

incorrect, incomplete, out-of-date or false information provided by a client, a specialist or another user,

the consequences of using the platform in a manner inconsistent with these Terms of Service, the law or the intended purpose of the platform.

3. Quality Island does not guarantee that the platform will operate without interruption, without errors, free from vulnerabilities, without failures, in line with the user's expectations or with constant availability.

4. Quality Island may temporarily limit, suspend or discontinue the operation of the platform for technical, security, legal, organisational, business or maintenance reasons, or because of force majeure.

5. Quality Island's liability towards users who are not consumers, regardless of its legal basis, is limited to actual damage and to the total net remuneration paid to Quality Island by that client in the 3 months preceding the event, unless mandatory provisions of law do not allow such a limitation.

6. The limitations of liability do not apply to the extent that excluding liability would be inadmissible under mandatory provisions of law, in particular in the case of damage caused intentionally.

10. Liability of the user and the client

1. The user is liable towards Quality Island for damage, costs, claims, penalties, losses, expenses, legal costs and other consequences arising from:

a breach of these Terms of Service,

a breach of the law,

an infringement of the rights of third parties,

the provision of untrue or incomplete data,

unlawful use of the platform,

a breach of confidentiality,

bypassing Quality Island,

the unauthorised copying, downloading or use of data and content from the platform,

actions that cause a breach of the security of the platform or of Quality Island's infrastructure.

2. The client undertakes to hold Quality Island harmless against third-party claims where the third party's claim arises from the client's act or omission, from data provided by the client, or from the client's breach of the law, these Terms of Service, an agreement, confidentiality, intellectual property rights or personal data protection.

11. Security of the platform

1. Quality Island applies technical and organisational measures intended to ensure the security of the platform, of data and of communication, appropriate to the nature of the platform, the scale of its business and the risks identified.

2. Users are not entitled to test the security of the platform on their own, in particular to carry out penetration tests, vulnerability scans, attempts to circumvent security measures, attempts at privilege escalation, code analysis, reverse engineering, fuzzing, resource enumeration, social engineering attacks or any other activity that could compromise security.

3. Any vulnerabilities, security flaws, incidents or suspected breaches that are noticed should be reported to: kontakt@qualityisland.pl, with the word "bezpieczeństwo" (security) in the subject line.

4. Reporting a vulnerability does not entitle the user to continue exploiting the flaw, to download data, to retain data, to disclose the vulnerability publicly or to demand payment, unless Quality Island expressly runs a bug bounty programme and its rules provide otherwise.

12. Intellectual property rights

1. The platform, its name, concept, layout, structure, graphic designs, interface, logo, trade marks, content, descriptions, profiles, filters, database, compilations, markings, code, operating mechanisms, marketing materials and other elements are the property of Quality Island or of the entities from which Quality Island has obtained the relevant rights.

2. Using the platform does not transfer any intellectual property rights to the user or grant any licence, other than a limited, non-exclusive, non-transferable and revocable licence to use the platform in accordance with these Terms of Service and its intended purpose.

3. It is prohibited to copy, modify, distribute, make publicly available, resell, decompile or reverse engineer the platform, to create derivative works, to create competing databases, or to use elements of the platform for purposes other than those permitted in these Terms of Service.

4. All rights not expressly granted to the user in these Terms of Service remain reserved to Quality Island or to the relevant rights holders.

13. User content and reports of unlawful content

1. Where the platform allows users to send, publish or share content, the user declares that they hold all rights and consents necessary to use it and that the content is lawful.

2. Users may not send content that is:

unlawful,

infringing copyright, trade marks, personality rights, privacy, the protection of personal data, trade secrets or other rights of third parties,

containing malware, viruses, exploits, phishing links or other harmful elements,

discriminatory, offensive, vulgar or contrary to the principles of community life,

misleading,

spam, or marketing content sent without the consent of Quality Island.

3. Reports concerning unlawful content, infringements of rights, misuse of the platform or other irregularities can be sent to: kontakt@qualityisland.pl.

4. A report should contain at least:

an indication of the content or place the report concerns,

a description of the infringement,

the contact details of the person making the report,

a statement that the report is true,

where applicable, documents or information confirming the rights of the person making the report.

5. Quality Island may remove, restrict the visibility of, block, label, hide or review content if it considers that the content breaches these Terms of Service, the law, the rights of third parties, the security of the platform, good practice or the interests of Quality Island.

6. Quality Island may also act on its own initiative, on the basis of a report, or on information from a public authority, a contractor, a specialist, a client, a security system or another reliable source.

7. Where the law requires Quality Island to inform a user about a moderation decision, Quality Island will provide the relevant information to the extent and within the time required.

14. Confidentiality

1. The information available on the platform, in particular specialist profiles, data on availability, rates, expectations, experience, technologies and preferences, commercial information, models of cooperation, offers, price lists, contact details, know-how, negotiation terms and information provided in the course of discussions with Quality Island, may constitute confidential information or a trade secret of Quality Island.

2. Users and clients undertake not to disclose, transfer, copy, use or distribute confidential information for any purpose other than assessing possible cooperation with Quality Island.

3. The obligation of confidentiality applies for as long as the platform is used and for a period of 5 years from the last contact with Quality Island and, as regards trade secrets, for as long as the information retains its confidential character.

4. A breach of confidentiality may result in liability for damages, an obligation to pay a contractual penalty where one has been stipulated in a separate agreement, and other claims available to Quality Island.

15. Personal data

1. The controller of the personal data processed in connection with the platform is Quality Island Sp. z o.o., unless in a particular case a separate notice or agreement indicates a different controller or joint controllers.

2. Personal data is processed in accordance with applicable law, in particular the GDPR and the relevant national provisions.

3. Detailed rules for the processing of personal data, including the purposes, legal bases, retention periods, categories of recipients, the rights of data subjects and contact details for data protection matters, are set out in the QA Board Privacy Policy, available at: https://qaboard.pl/privacy-policy

4. A user who provides the personal data of other people, in particular employees, associates, candidates, specialists, contact persons or representatives of a client, declares that they have an appropriate legal basis for providing it to Quality Island and that they have fulfilled the required information obligations towards those people.

5. The client should not send Quality Island excessive data, special categories of personal data, data concerning criminal convictions and offences, medical data, financial data, login credentials, production data, end client data or other sensitive data, unless this is necessary, lawful and agreed in advance with Quality Island.

6. Where, as part of the cooperation, Quality Island is to process personal data on behalf of the client, the parties will conclude a separate data processing agreement if one is required.

16. Cookies and similar technologies

1. The platform may use cookies, local storage, session storage, pixels, tags, analytics tools, marketing tools or similar technologies.

2. Detailed rules for the use of cookies and similar technologies are set out in section 17 of the QA Board Privacy Policy, available at https://qaboard.pl/privacy-policy, and in the consent banner available on the platform.

3. Users can manage cookie settings in their browser settings or in the consent banner, where one is available.

17. Complaints

1. A user may submit a complaint concerning the operation of the platform or the services provided electronically to the email address: kontakt@qualityisland.pl.

2. A complaint should contain:

the first name and surname or the company name of the person making the complaint,

a contact email address,

a description of the problem,

the date on which the problem occurred,

the expected way of resolving the matter,

additional information or attachments, if they are needed in order to consider the complaint.

3. Quality Island considers a complaint within 14 days of receiving it, unless the law or the nature of the matter requires a different deadline.

4. If a complaint needs to be supplemented, Quality Island may ask the person making it for additional information. The time spent waiting for that information may extend the deadline for considering the complaint.

5. The reply to a complaint will be sent to the email address indicated by the person making it.

18. Consumers and sole traders treated as consumers

1. The platform is intended primarily for business clients, entrepreneurs, institutions and people acting in connection with their professional or business activity.

2. Where the platform is used by a consumer or by a sole trader treated as a consumer, these Terms of Service do not limit the rights granted to them by mandatory provisions of law.

3. Provisions concerning limitations of liability, contractual penalties, jurisdiction, the prohibition of set-off, unilateral amendments to these Terms of Service or other matters will not apply to a consumer or to a sole trader treated as a consumer to the extent that they would be prohibited or contrary to mandatory provisions of law.

4. If in the future Quality Island allows consumers to purchase services directly through the platform, these Terms of Service will be supplemented with the required information on price, the right of withdrawal, exceptions to the right of withdrawal, methods of payment, the manner of performance and out-of-court complaint and redress procedures.

19. Suspension, blocking and refusal of access

1. Quality Island may temporarily or permanently limit, suspend or block a user's access to the platform, to its functions or to particular content where:

the user breaches these Terms of Service,

the user breaches the law,

the user's actions threaten the security of the platform, the data, the infrastructure or other users,

there is a suspicion of misuse, of bypassing Quality Island, of scraping, of automated data harvesting or of competing activity,

this is necessary to protect the rights of Quality Island, specialists, clients or third parties,

this is required by law or by a public authority, a court or another authorised body.

2. Quality Island may refuse to provide services to a user who has breached these Terms of Service, acted in bad faith, provided untrue data, breached confidentiality, bypassed Quality Island or acted to the detriment of Quality Island.

3. Blocking or restricting access does not exclude Quality Island's right to pursue claims.

20. Availability, technical breaks and development of the platform

1. Quality Island develops the platform on an ongoing basis and may introduce updates, fixes, new functions, interface changes, naming changes, changes to filters, changes to the available profiles and other modifications.

2. The platform may be temporarily unavailable because of technical work, failures, updates, actions of infrastructure providers, network problems, security events, force majeure or other causes beyond Quality Island's control.

3. Quality Island is under no obligation to keep the platform unchanged or to make particular functions, profiles, filters or content available for any particular period.

21. External links and third-party tools

1. The platform may contain links to websites, services, tools, payment systems, forms, calendars, messaging apps, analytics platforms, marketing tools or other third-party solutions.

2. Quality Island is not liable for the operation, content, terms of service, privacy policies, security or availability of third-party services, unless mandatory provisions of law provide otherwise.

3. The use of third-party services may be subject to those parties' own terms of service and privacy policies.

22. Force majeure

1. Quality Island is not liable for the non-performance or improper performance of its obligations resulting from circumstances beyond its control that could not have been foreseen or prevented with due care.

2. Force majeure includes in particular infrastructure failures, network failures, cyberattacks, actions of public authorities, changes in the law, wars, riots, epidemics, pandemics, natural disasters, strikes, power outages, failures of technology providers, failures of hosting services and other events of a similar nature.

23. Amendments to these Terms of Service

1. Quality Island may amend these Terms of Service for important reasons, in particular in the event of:

a change in the law,

a change in the platform's operating model,

the introduction of new functions,

a change in the scope of the services,

a need to clarify the provisions,

a need to increase the security of the platform,

the prevention of misuse,

organisational, technical or business changes at Quality Island.

2. The current version of these Terms of Service is published on the platform.

3. An amendment takes effect on the date indicated in the new version of these Terms of Service, unless mandatory provisions of law require a different procedure.

4. Agreements concluded before an amendment are governed by the provisions in force at the time the agreement was concluded, unless the parties agree otherwise or the amendment results from mandatory provisions of law.

24. Governing law and disputes

1. These Terms of Service are governed by Polish law.

2. Any disputes between Quality Island and a user who is neither a consumer nor a sole trader treated as a consumer will be settled by the court having jurisdiction over the registered office of Quality Island.

3. In the case of consumers and sole traders treated as consumers, jurisdiction is determined in accordance with mandatory provisions of law.

4. Before bringing a matter before a court, the parties should attempt to resolve the dispute amicably, in particular through email contact and an exchange of positions.

25. Final provisions

1. These Terms of Service enter into force on the date of their publication on the platform, unless another date is indicated.

2. If any provision of these Terms of Service proves to be invalid, ineffective or unenforceable, this does not affect the validity of the remaining provisions. An invalid provision is replaced by the provision closest in economic and legal terms to the purpose of the original provision, to the extent permitted by law.

3. Quality Island's failure to exercise a right arising from these Terms of Service does not constitute a waiver of that right.

4. The headings in these Terms of Service are for convenience only and do not affect the interpretation of the provisions.

5. Matters not covered by these Terms of Service are governed by the relevant provisions of Polish law.

6. These Terms of Service are published in Polish and in an English translation. The binding version is the Polish one. In the event of any discrepancy between the language versions, the Polish wording prevails.
